Because Jinkers.Net does not permit infringement of intellectual property rights through the Jinkers.Net Services, we will remove all Member Content, if properly notified, that such Site Content or Member Content infringes on another's intellectual property rights or copyrights, and at our sole discretion.

Jinkers.Net does not endorse any Member Content or any opinion, recommendation, or advice expressed therein, and we expressly disclaim any and all liability in connection with Member Content. You agree that you will not submit Member Content that violates the Site Rules, or material contrary to applicable local, national, and international laws and regulations.

Ownership & Licenses (Member Content)

We do not claim ownership rights over your Member Content. However, you grant us the following worldwide, royalty-free and non-exclusive license to use, distribute, reproduce, modify, adapt, publicly perform and publicly display Member Content through the Jinkers.Net Services, solely for the purpose for which such Member Content was submitted or made available. This limited license exists only for so long as you elect to include Member Content through the Jinkers.Net Services and it will terminate at the time you remove or we remove such Member Content from the Jinkers.Net Services, or you or Jinkers.Net terminates your membership or access Jinkers.Net or it's Services. You grant each user of the Jinkers.Net Services a non-exclusive license to access your Member Content through the Jinkers.Net Services, and to use, reproduce, distribute, display and perform such Member Content as permitted through the functionality of the Jinkers.Net Services and under these Terms of Use.

Notwithstanding the foregoing, you understand and agree that once Member Content is incorporated into other aspects of the Jinkers.Net Services by Jinkers.Net and/or its members, Jinkers.Net is under no obligation to delete or ask or require other Jinkers.Net members to delete that Member Content, and therefore, it may continue to appear and be used through the Jinkers.Net Services indefinitely pursuant to an irrevocable, worldwide, royalty-free license. You understand and agree that we may retain, but will not display, distribute, or perform, server copies of Member Content that have been removed or deleted.

Permitted Use of Content

The content associated with the Jinkers.Net Services, including without limitation, the text, software, scripts, graphics, photographs, sounds, music, videos, visual interface, design, computer code, interactive features and the like ("Site Content") and the trademarks, service marks, trade names and logos contained therein, except all Member Content, are owned by or licensed to Jinkers.Net, subject to copyright and other intellectual property rights under the law. Except as expressly and unambiguously provided herein, Jinkers.Net does not grant you any express or implied rights, and all rights in and to the Jinkers.Net Services and the Site Content are retained by Jinkers.Net.

You may access Member Content for your information and personal, non-commercial use solely as intended through the provided functionality of the Jinkers.Net Services. Member Content and Site Content are provided to you "AS IS" and "AS AVAILABLE" for your information and personal, non-commercial use only, to be used solely as intended through the provided functionality of the Jinkers.Net Services and may not be downloaded, copied, reproduced, distributed, transmitted, broadcast, displayed, sold, licensed, or otherwise exploited for any other purposes whatsoever without the prior written consent of the respective owners, and it may not be used as prohibited under the Terms of Use.

Copyright Infringement Policy

In accordance with the Digital Millennium Copyright Act ("DMCA") and other applicable laws, we have adopted a policy of disabling or terminating, in appropriate circumstances and at our sole discretion, the account of any Jinkers.Net member who infringes the intellectual property rights of you, us, or any third party. If you believe that your work has been copied in a way that constitutes copyright infringement, or your intellectual property rights have been otherwise violated, please notify us by following our DMCA notification procedure.

Member Accounts

In order to participate in the Jinkers.Net Services, you must create an account and become a Jinkers.Net member. All members will enter their own password and are responsible for maintaining confidentiality of such password. Each member's right to use the Jinkers.Net Services is personal to the member and members are entirely responsible for any and all activities which occur under their account whether authorized or not authorized. You agree to notify Jinkers.Net of any unauthorized use of your account or any other breach of security known or that should be known to you. You acknowledge and agree that you are solely responsible for your interaction with other members of the Site, and that we have no obligation to monitor or resolve disputes between members of the Site.

Member Conduct

You may not use the Jinkers.Net Services for any purpose that is unlawful or prohibited by the Terms of Use and/or any applicable additional terms, including the Site Rules. Your access to Jinkers.Net Services may be terminated immediately, in our sole discretion, with or without notice, if you fail to comply with any provision of the Terms of Use and/or additional terms, including the Site Rules, or for any other reason, or no reason. Termination of Service

You agree that Jinkers.Net, in its sole discretion, has the right, but not the obligation, to delete or deactivate your member account, block your IP address, or otherwise terminate your access to or use of the Jinkers.Net Services, or any part thereof, immediately and without notice, and remove and delete any Member Content on the Jinkers.Net Services, for any reason, including, without limitation, if we believe that you have violated or acted inconsistently with the letter or spirit of the Terms of Use. Further, you agree that Jinkers.Net will not be liable to you or any third party for any termination of your access to the Jinkers.Net Services. Further, you agree not to attempt to use the Jinkers.Net Services after your member account has been terminated.

You agree that if you are dissatisfied with the Jinkers.Net Services, if you do not agree with any part of the Terms of Use, or if you have any other dispute or claim with or against us with respect to the Terms of Use or the Jinkers.Net Services, your sole and exclusive remedy is to discontinue using the Jinkers.Net Services.

Membership Fees / Refund Policy

Jinkers.Net members may have Memberships at the "Free" level or may sign up for a paid membership. Jinkers.Net charges membership fees for each paid membership account. Paid membership account fees are not automatically renewed. Jinkers.Net will automatically charge the membership fee to your designated payment method upon your activating and paying for a membership and you authorize us to charge such payment method for the appropriate membership fees and amounts stated. Jinkers.Net reserves the right to increase membership fees or to institute new fees at any time upon reasonable notice (a minimum of 30 days) posted in advance on the Site. The act of paying fees does not exclude you from the Terms of Use or the Site Rules, which must be adhered to by all members.

Membership fees are charged up-front. Jinkers.Net does not provide refunds or credits for any membership fees. Downgrades to a less expensive membership or cancellation of any membership or termination of any membership will not result in any refund or credit of fees already paid. The cancellation or downgrade of a membership will go into effect at the end of the then-current billing cycle. We may offer other paid services or features associated with the Jinkers.Net Services, subject to specified terms and conditions, which are incorporated by this reference.

The Jinkers.Net Services may provide links to other websites or resources. Because we have no control over such websites and resources, you acknowledge and agree that Jinkers.Net is not responsible for the availability of such external websites and resources, and does not endorse and is not responsible or liable for any content, advertising, products or other materials on or available from such websites or resources. You further acknowledge and agree that we will not be liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use or reliance on any such content, goods or services available on or through any such website or resource.

You agree that all Jinkers.Net's trademarks, including Jinkers.Net trade names, service marks, logos and service names are trademarks and the property of Jinkers.Net. Without our prior permission, you agree not to display or use in any manner any Jinkers.Net mark. All trademarks included in the Jinkers.Net Services not owned by Jinkers.Net are the property of their respective owners. Nothing contained on the Jinkers.Net Site or Services may be construed as granting, by implication, estoppel, or otherwise, any right or license to use any trademark.

Disclaimer of Warranties / Limitation of Liability

You understand and agree that the Jinkers.Net Services are provided "AS-IS" or "AS AVAILABLE," and that we assume no responsibility for your ability to (or any costs or fees associated with your ability to) obtain access to the Jinkers.Net Services, nor do we assume any liability for the failure to store or maintain any user communications or personal settings.

If there is any claim or dispute about or involving the Jinkers.Net Services, you agree that the claim or dispute will be governed by the laws of the State of Georgia, United States of America, without regard to conflict of law provisions. Jinkers.net provides the means for person to person display, marketing, and communication on an individual and professional level between models, photographers, hair and makeup artists, clothing designers, photo retouchers, agents, and other professionalsin this industry that provide a service. Jinkers.net does not own or claim to own any personal portfolio content or images uploaded by individual users for individual promotion and presentation. It is the responsibility of the user to abide by this agreement and site guidelines. Jinkers.net uses various third party payment systems; each user is responsible to review and abide by the rules of those systems.

B. . Disclaimer: The Service and the Site contains information, facts and opinions from various individuals and organizations. You acknowledge that Jinkers.net and its affiliates do not control the information available on the site and that any opinions, advice, statements, services, offers or other information or content presented or disseminated on any page, whether public or private, are those of their respective authors who are solely liable for their content.

Jinkers.net and its affiliates reserve the right, at their sole discretion, to edit, refuse to post, or remove any material, links, email addresses, images, and content submitted to, or posted on the site. Jinkers.net and its affiliates reserve the right, in their sole discretion, to deny access to the e-mail systems provided for general community use. Jinkers.net has guidelines regarding posting of appropriate images, email addresses, content, and links. You agree to read and adhere to the guidelines as posted throughout the site. Any member images may, at the discretion of Jinkers.net, be displayed on the Latest Images page and some may also be selected for display in the Home Page Gallery "Featured Models", "Featured Photographers", "Model of the Month", or "Photographer of the Month".

NEITHER Jinkers.net NOR ANY OF ITS SUBSIDIARIES, DIVISIONS, AFFILIATES, AGENTS, REPRESENTATIVES OR LICENSORS SHALL BE LIABLE TO YOU OR ANYONE ELSE FOR ANY LOSS OR INJURY OR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE OR SIMILAR DAMAGES ARISING OUT OF YOUR ACCESS OR USE OF, OR YOUR INABILITY TO ACCESS OR USE, THE SERVICE AND THE SITES AND THE INFORMATION AVAILABLE ON THE SERVICE AND THE SITES OR ARISING OUT OF ANY ACTION TAKEN IN RESPONSE TO OR AS A RESULT OF ANY INFORMATION AVAILABLE ON THE SERVICE AND THE SITES. English is the language used on this website and all communication on or through Jinkers.net should be in this language.

H. Members must not make comments or casting calls on behalf of non-members nor may they advertise or promote non-modeling or non-photography goods or services or work through casting calls or other sections of the site. With the exception of photographers directly hiring or engaging models for their own projects, or models seeking models, only registered Agency account holders may scout or recruit other members through JInkers.net. Only registered JInkers.net account holders may create threads in the dedicated sections.

I. Jinkers.net and its affiliates do not review or monitor any web sites linked to the Service or from personal portfolios on this site. When clicking links to personal pages from Jinkers.net all users of the system acknowledge that Jinkers.net is not responsible for the accuracy or content of those links.

J. You agree not to post URL's and other web links in any form, into your profile, comments, or any other areas of the site, as links or text, that lead to ADULT SITES or Pay Sites. Jinkers.net reseves the right to remove from it's sites any references or portfolios containing Adult Sites or Pay Sites without notice.

K. Additionally certain links to sites, as determined from time to time by Jinkers.net, or the use of links and web addresses, or the use of html formatting and scripting in certain portfolio types as determined by Jinkers.net, may not be permitted within the portfolio or as an acceptable use of the personal home page link or as portfolio content.

L. Links and/or URLs to Facebook personal pages or Facebook Groups are not permitted in profile notes, casting calls, or forum posts.

M. Jinkers.net is under no obligation to provide exposure to competing sites through links or other methods in portfolio and may remove those at its discretion, and without notice. 'VOTE FOR ME' canvassing and 'competition' promotion are not allowed. Telephone numbers and e-mail addresses may not be displayed in forum posts, casting calls, or profile notes. The Jinkers.net referral system is intended for work related offers and general enquiries related to or leading to work or further discovery. Promotion of services and goods is not an appropriate use of the referral system. Jinkers.net permits one main free member portfolio per person.

N. The Promotion and Recruitment of Escorts, Escort Services, Personal Companions, (etc.) are contrary to the purposes of Jinkers.net, and will not be tolerated in any fashion. Soliciting for, recruiting, or offering the services of escorts on this site is strictly prohibited. Portfolios that are used for the solicitation or promotion of escort services in ANY way will be immediately disabled with no refund. This includes (but is not limited to): Use of the referral system, hyperlinks to external sites promoting escorts, URLs (web addresses) promoting escorts and any other activity that the staff of Jinkers.net deems as solicitations, promotions, or offers

O. Jinkers.net has a stated policy regarding the posting of sexually explicit images to its web pages. Sexually explicit images are not permitted on this site. Sexually explicit images include but are not limited to images of sexual intercourse, obvious states of sexual arousal (erections), or overt sexual positions (such as noticeably visible or spread genitalia). Tasteful male full frontal nudity is acceptable as long as the penis is flaccid and not being touched. Failure to adhere to this restriction will result in the removal of the images, and the disablement of that member portfolio. Consistent misclassification (rating) or categorization of images may result in the forced setting of ratings or gross violations may result in the removal of your portfolio.

P. Jinkers.net does not support bandwidth theft, the linking of images from Jinkers.net to other sites, or the misuse of links from Other sites to Jinkers.net. Anyone found linking images from Jinkers.net to other sites, copying content from Jinkers.net, or inappropriately linking to Jinkers.net (to increase their views - through use of hidden frames, or using programs to artificially raise page views etc.) will result in permanent REMOVAL from Jinkers.net without notification.

Q. You should be aware that if you voluntarily disclose personal information (e.g., user name, email address) within your portfolio, as a comment on the site, that the information can be collected and used by others and may result in unsolicited messages from other parties, and shall therefore be the sole responsibility and liability of the poster. Note that once the search engines have cached a page it may remain on their servers for a considerable period of time.

R. As a member of Jinkers.net - you will be contacted by other system members seeking to work with you, as well as occasional emails from Jinkers.net. As new features or member programs and promotions are developed and launched you will be informed via the postings to the site and also by email.

S. This User Agreement and any disputes arising out of or related to the Service and the Sites shall be governed by, and construed and enforced in accordance with, the laws of the United States of America. By your usage of, or your posting to, this site constitutes your agreement to, but not limited to, the current conditions listed in this agreement.

T. Jinkers.net is not intended for users under the age of 18. If you are 17 years or younger do not submit a portfolio or any personal information. It will be Deleted upon discovery.

U. Jinkers.net reserves the right to change and modify these usage rules as appropriate and without notice.

V. Jinkers.net may use any of the images a member submits for the top banner on the homepage provided a link is placed to that members profile and the members are mentioned on the pop-up text banner below the scrolling images. Jinkers.net administrators will contact the member holding that image in their portfolio prior to use as a courtesy, but does not have to do so.

W. Members are not permitted to promote or advertise in any way activities that involve sexual contact between photographers and models as part of shoots (often termed "gonzo" or "point of view").

In addition Members are also not permitted to promote or advertise for work that includes sexual contact between male and female; whether clothed or un-clothed. Members who engage in these styles of work or activities, through the site or the internal messaging system, will have their memberships cancelled.

X. Violation of any of the above Terms and Conditions will cause your membership to be terminated.

Y. Moderator and Administrator decisions are final.
